1. Who we are

Chipper's Golf LLC ("Chipper's Golf," "we," "us") operates a private, members-only indoor golf club at 19A Corporate Drive, Unit 1, Essex Junction, Vermont. These terms govern your use of chippersgolf.com, your membership, and your use of the club. By creating an account, joining the email list, or purchasing a membership you agree to them.

2. Accounts

You must be at least 18 to hold an account or membership. Keep your password private and tell us promptly if you believe your account has been used without your permission. You are responsible for activity under your account, including sessions booked and guests you bring.

3. Membership and billing

Memberships are sold on the pricing page and billed by card through Stripe. Prices shown there at the time you subscribe apply to you.

• Monthly membership ($229/month) renews each month and may be cancelled at any time from your dashboard; cancellation takes effect at the end of the paid period and no partial refunds are given.
• Annual membership billed monthly ($179/month) is a 12-month commitment. It cannot be cancelled during the commitment period; after that it continues month to month and may be cancelled as above.
• Prepaid annual membership ($1,999) is paid once for twelve months and is not refundable once the club has opened to you.
• Practice Pass ($99/month) renews monthly and may be cancelled at any time, effective at the end of the paid period.
• Initiation fee. Memberships purchased after the founding forty are filled carry a one-time $150 initiation fee, charged with the first payment.

If a payment fails we will retry it and notify you. While a membership is unpaid, booking and door access are suspended. A membership that remains unpaid is cancelled.

4. Founding memberships

The first forty memberships are founding memberships. A founding membership's monthly rate is locked for 24 months from its start date and pays no initiation fee. The lock ends early if the membership is cancelled or lapses for non-payment; a founding spot given up is offered to the next member at the published rate.

5. Booking, hours and access

Members reserve time on the simulator bay and putting green through the dashboard, subject to the daily limits, advance windows, reservation caps and guest allowances of their membership as described on the pricing page. Off-peak play is included in the membership. Peak time draws from the monthly included peak hours; time beyond that, and purchased hour packs, are charged to the card on file at the published rates.

• Reservations may be cancelled up to 30 minutes before they start for a full return of any hours used.
• Purchased hours carry over and do not expire while your membership is active.
• Included hours reset each billing cycle and do not carry over.
• Your key fob opens the door only during a reservation you hold. Do not admit anyone who is not your guest, and do not share your fob or credentials.

6. Guests

Members whose plan allows guests may bring up to three on their booked time at no charge. Guests must be accompanied by the member, are the member's responsibility, and may be asked to sign the club waiver before play.

7. Conduct, safety and property

The club is unstaffed for most of its hours. Use the equipment as instructed, wear appropriate footwear, and leave the bay as you found it. You are responsible for damage caused by you or your guests beyond normal wear. We may suspend or end a membership, without refund of the current period, for conduct that endangers people or equipment, violates these terms, or abuses the honor-system store.

Golf involves risk of injury. You play at your own risk, and by using the club you agree to the membership agreement and waiver presented at sign-up.

8. Store purchases

Snacks and drinks in the clubhouse are sold on an honor system through the dashboard and charged to your card on file. Prices are shown before you confirm.

9. Communications

We send transactional email about your account, bookings and billing. If you opt in, we also send marketing email (unsubscribe at any time) and booking reminders by SMS (see the SMS terms). Message and data rates may apply.

10. Changes

We may change prices, hours, booking rules or these terms. Price changes do not affect a founding membership during its rate lock or a prepaid membership during its paid year. We will give notice of material changes by email at least 30 days before they take effect.

11. Liability

To the extent permitted by Vermont law, Chipper's Golf is not liable for indirect or consequential losses, and our total liability to you for any claim is limited to the membership fees you paid in the twelve months before the claim arose. Nothing here limits liability that cannot be limited by law.
